Long-Term Disability Benefits Provided Through Mutual of Omaha
Long-term disability (LTD) insurance replaces a portion of an individual’s lost income when they cannot return to work due to a non-job-related injury or illness. Anyone who works at least 30 hours per week and is between 18 and 61 is eligible to sign up. Mutual of Omaha offers various coverage options when you purchase a policy. With one of their plans, you could receive payments of up to $12,000 every month. The duration of benefits could be anywhere from two years to the age of 67.
LTD income insurance includes the following:
- Monthly benefits based on your current income. The maximum payment allowed is $12,000.
- Benefit period – 2, 5, or 10 years, or until you turn 67 years old.
- Elimination period – 60, 90, 180, or 365 days. (The timeframe between the date your disability started and when you receive your first payment).
- Policy issued to individuals between 18 and 61 years of age.
- Premium – Monthly premium is the same until you turn 67 years old. After that, it will increase annually. Coverage may continue until age 75.
There are two different packages available, and whether you qualify will depend on the extent of your disabling condition and if you can work at a diminished capacity or not at all. These packages are explained below:
Total disability income benefit – If you are not working in another occupation, and your disability prevents you from completing your job duties, you could receive monthly benefits after the elimination period ends. You will continue to receive payments if you have not reached the maximum benefit coverage after 24 months and still can’t perform any job for which you have the education, qualifications, experience, and training.
Proportionate disability benefit – If you can continue to work, but you’re unable to complete your work-related tasks within the time you usually do, and your monthly income losses are at least 20%, you would receive monthly benefits proportionate to your lost income. Benefits begin after the elimination period and last up to 24 months.
Other provisions on your Mutual of Omaha policy could include:
- Guaranteed renewable – If you pay your monthly premium by the due date, they will not cancel your policy up until you turn 67. After 67, coverage can continue until you reach 75 years of age as long as you continue to pay your premium and work full-time.
- Waiver of premium – If your disability lasts longer than 90 days, they will waive your premium for coverage and optional riders. There will also be a refund of premiums during this period.
- Terminal illness benefit – If you develop a terminal illness, you can accelerate a maximum of 12 months of disability benefits.
- Rehabilitation benefit – You could qualify for vocational rehabilitation services covered by the insurance company.
- Survivor benefit – Your beneficiaries will receive a lump-sum payment equal to three times your total monthly benefit if you die while you have a disability.
There are also some exclusions you should be aware of that could make you ineligible for LTD benefits. These include losses from:
- Mental or nervous disorders
- An act of undeclared or declared war
- A policy that is not in force
- Serving in the armed forces
- Self-inflicted injury
- Suicide or attempted suicide
- Committing or attempting to commit a felony offense
- Legal intoxication or under the influence of a narcotic or illegal substance
- Benefits provided through state or federal workers’ compensation insurance
- Substance abuse
- Employer’s liability or occupational disease law
Do I Need a Mutual of Omaha Disability Insurance Claims Lawyer?
You don’t have to seek legal representation, but it’s best if you do. Insurance companies use various tactics to deny a person’s claim or provide minimal benefits. Capitan Law will not allow them to take advantage of you. With an attorney by your side, you can ensure you will have a fair chance of fighting for the LTD payments you deserve.
When you hire us, we will handle every step of the claims process from beginning to end, including:
- Filing the claim.
- Requesting a copy of your Mutual of Omaha insurance policy.
- Obtaining medical evidence of your disability.
- Finding experts that can confirm you have a disabling condition and can no longer work.
- Submitting all documentation we find during our investigation to the insurance company.
- Communicating with the representative handling your claim.
- Ensuring Mutual of Omaha pays the monthly benefits you deserve based on your policy.
If you end up with a denied claim, we can file an appeal. The Employee Retirement Income Security Act (ERISA) regulates these plans to protect participants and provide necessary information about the policy and other details. If you have LTD through your employer, we must follow ERISA law while handling your appeal.
ERISA requires that you file an administrative appeal within 180 days of the denial date. If this period passes, you will likely lose your right to appeal Mutual of Omaha’s decision. We will review the denial letter to determine their reasoning and create a customized appeal strategy to overturn their decision.
We might have to submit new evidence and documentation that wasn’t in the original claim. This might include documentation, such as:
- Statements from vocational experts about the disability’s effect on your capacity to perform your job
- Physician letters confirming your disabling condition
- Missing or incomplete medical records
- Copy of your job description
- Functional capacity reports
- Affidavits from key witnesses
After we file an appeal, Mutual of Omaha will have up to 45 days to respond. They can request one 45-day extension if they need additional time. If they continue to deny your LTD benefits, we will move forward with a lawsuit.
